My spouse is trying to kick me out of our home. Is that legal?

It’s not legal to remove somebody from their home. Your spouse can’t ask you to leave, make you leave. Certainly, if you’re in a situation where you feel it’s dangerous, if you feel that it’s not in your best interest to be there, leave. There is no such thing as abandonment in Florida. You’re not giving up your rights to your home if you feel like you need to leave for your own protection. You’re not giving up your rights to your home even if you feel like I need to leave for your own peace of mind. Leave if you feel comfortable that that’s in your best interest leaving, knowing you’re not giving up your rights, but if you decide to stay that’s your home too and you’re just as entitled to be there as your spouse.
