Is my spouse entitled to a portion of my business in Florida?

Your spouse may be entitled to a portion of your business. In Florida, when you’re looking at the value of the business, there’s value of the assets of the business, the building, perhaps any stock that the business may hold, but most businesses, the real value in it is goodwill. That would be your relationship with your customers and that is not divisible. A spouse may be entitled to a portion if that business was built during the marriage, expanded during the marriage, and your spouse put their own blood, sweat, tears and cash into that business. They may be entitled to a portion of it, but the actual calculation of that portion again would become a narrow issue because your goodwill, your relationship with your customers is not something that the state of Florida, the courts, will put a dollar value on.
