How are assets split in a divorce?

Florida is a shared property state, meaning that marital assets, meaning things that were accumulated during the course of the marriage are shared equally. Now, there are circumstances where it could be an unequal distribution of those assets and those are very case-specific as to special needs that one party may have over the other party.

Initially, you need to think of things as anything that was brought into the marriage before the marriage is premarital, and that would be yours or your spouse’s exclusive property. Anything accumulated during the marriage is probably going to be divided evenly.
