Can my spouse tell me that I cannot see my kids?
Your spouse can’t tell you that you can’t see your kids. A judge can tell you that you can’t see your children. What you’ll need to do in those circumstances is to speak with your attorney. There are a lot of factors that a judge takes into consideration at the end of the case to determine time-sharing arrangements, how much time the child spends with each parent, parental responsibility, who gets to make the decisions regarding the upbringing of the child, and those factors included in those factors are, do I co-parent well? In other words, do I share my time with the child? Do I encourage a strong relationship between my child and the other parent?
Just preventing one parent from seeing the child may seem like a short-term answer, but it’s going to be a long-term problem. Now, if your child is placed in danger by the other parent, then absolutely the parent can say no, but it’s important to talk to your attorney about that because again, those circumstances are very limited.
