Divorce

Going through a divorce is an emotional ordeal even under the best of circumstances. Annulment

Some marriages are void under Florida law because they violated some legal prohibition against marrying, such as a marriage to someone below the legal minimum age, marriage between people who are too closely related under Florida law, or marriage to someone who is still legally married to someone else. Other marriages are voidable, meaning they can be cancelled (annulled) if one of the parties to the marriage institutes annulment proceedings in a timely fashion. Examples of voidable marriages include marriages where one party was too intoxicated to consent to the marriage or was unduly pressured or even tricked into marriage. Keep in mind that voidable marriages can also be affirmed if the parties continue to stay married after learning of the legal disability. We’ll counsel you on your legal rights and options regarding annulment and guide you through the necessary procedure.

Paternity

If parents are unmarried when a child is born and do not take the appropriate steps to timely acknowledge the child’s paternity, that child will not have a legal father until paternity is established in a court proceeding. Only a legal father can enforce his rights to custody and visitation (parenting and time-sharing), and only a legal father can be forced to pay child support. Establishing parentage is also important for a host of other reasons that will benefit the child.
